TERMS & CONDITIONS OF THE BOOKING

CONTRACT:

 

The Contract for a short-term holiday rental will be between the Owners of Curlew 1 The Cove (referred to as “us” or “we”) and the person making the booking and all members of the holiday party (referred to as “you” or “your”) under the following booking conditions. UK law will govern the Contract. The contract of hire is not effective until we have received and processed the deposit. The contract will be subject to these booking conditions and must be complied with. The party leader must be at least 18 years of age at the time of booking and the booking form must list all names, addresses and ages of your party.

 

BOOKING PERIODS:

 

From 16:00 to 10:00 Friday to Friday (in off-peak short breaks 3 ; 4 night and other periods by arrangement. Booking must be by the accredited Booking Form on the Curlew 1 The Cove website (unless via 3rd Party we currently allow 3rd Party Bookings via booking.com / airbnb.com)

 

PAYMENT:

 

Bookings are confirmed on receipt of 20% deposit at the time of booking cost. The deposit must be paid within 1 day of the booking being placed and approved. The balance of the booking will be due for payment 60 days prior to the booking commencement date. We will send you a one off reminder 5 days before the remaining full payment is due. Holidays booked within 60 days of the commencement date of the holiday must be paid in FULL.

 

CANCELLATIONS:

 

Cancellations must be immediately notified to us in writing or email. The treatment of a cancellation will depend on the circumstances, the date the booking was made and when the cancellation is notified to us. In all circumstances we will make every effort to minimize the cost of the cancellation by endeavouring to re-let the accommodation and in certain circumstances we will agree to change the dates of the original booking to other dates and this may be at an increased tariff depending on the holiday period selected. An administration charge for any agreed change may be made.

 

CANCELLATION CIRCUMSTANCES:

 

National Lockdown – In the event of a Government Imposed national lockdown that coincides with your holiday, where you are legally unable to travel, and we are legally prevented from opening, you will receive a full refund.

 

Regional/Local Lockdown – In the event that the address given on the booking is put into Local/Regional Lockdown, rendering you legally unable to travel, and the period of restriction covers the period of your booking, you will receive a full refund. Please note that this applies only to the address given on the booking by the lead booker and does not apply if an unidentified party member at a different address is unable to travel due to local lockdown.

 

Cancellation by you – If you or any member of the intended party is unable or disinclined to travel for any reason – this includes but is not limited to illness (including COVID), a requirement or recommendation to self isolate, or quarantine, shielding, a call to jury duty, military service, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport. These remain at your risk and do not give a right to cancel and receive a refund unless we re-let the cottage – other than in accordance with the notes below – YOU ARE STRONGLY RECOMMENDED TO TAKE OUT CANCELLATION INSURANCE WHICH COVERS MANY OF THE ABOVE EVENTUALITIES (see details below) you accept responsibility for any loss you may incur due to your cancellation of the booking.

 

Scale of cancellation and alteration charges

 

More than 60 days 25% of the deposit booking cost

 

30-59 days 40% of the full booking cost

 

15-29 days 75% of the full booking cost

 

0-14 days 90% of the full booking cost

 

0-2 days 100% of the full booking cost

 

Part Cancellations – If any person(s) in your party needs to cancel, this will not affect the total cost of your booking.

 

In addition, no refunds are payable in the event that you cut short your stay.

 

Holiday Cancellation Insurance

 

It is the responsibility of the Lead Guest to acquire suitable insurance to cover their holiday at their discretion, which includes Cancellation and Curtailment Protection. There are several suitable options which may include cover for Covid related cancellations. We are not regulated to sell, promote, endorse or recommend any insurance product – nor do we benefit financially or have any formal relationship with any of the suggested providers below:-

CANCELLATION BY US

 

If Curlew 1 The Cove; is hindered or prevented by a Force Majeure event (please see definition below), Curlew 1 The Cove may, at its sole discretion, offer you: i) a full refund; or ii) alternative holiday dates; or iii) such other remedy as Curlew 1 The Cove considers appropriate with regard to the circumstances. No additional compensation, expenses or costs will be payable.

 

Definition Force Majeure

In this contract, a Force Majeure event means any of the following circumstances which may hinder or prevent the performance of the contract, including but not limited to:

  • acts of God, flood, drought, earthquake or other natural disaster; epidemic or pandemic;
  • terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
  • nuclear, chemical or biological contamination or sonic boom;
  • any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent;
  • collapse of buildings, fire, explosion or accident;
  • any labour or trade dispute, strikes, industrial action or lockouts; non-performance by suppliers or subcontractors; and interruption or failure of utility service.

 

3RD PARTY BOOKINGS

 

All bookings made through 3rd party agencies (e.g booking.com / airbnb.com – these Terms and Conditions above do not apply. Please refer to the 3rd party agencies Terms and Conditions applicable at the time of your booking.

 

GROUP BOOKINGS

 

We reserve the right to refuse group bookings or other persons who in our opinion are unsuitable for the accommodation. We do not accept bookings from participants of Stag / Hen Parties. We do not accept Bookings from Groups of more than 10 people (including Children – specifically where part of the Group may be staying elsewhere on The Cove Fishcombe Cove development (if you have any concerns or queries about this PLEASE contact us before booking. The maximum number of people allowed inside and on the Patio Area of Curlew 1 The Cove at any time is 6 people (Adults and Children). This is due to being respectful for our neighbours, some of which are private residential dwellings and private second homes that are not Holiday Lets.

 

NO OF PERSONS

 

The number of persons allowed to stay overnight in Curlew 1 is 4 people (a combination of Adults and Children with at least one responsible Adult aged over 21). Babies in Cots are allowed in addition. You must bring your own Cot and High Chair in this circumstance. You must satisfy yourselves that the accommodation offered will meet your requirements and we make no representations regarding suitability for more than the specified occupancy.

 

KEYS

 

The keys will be the responsibility of the hirer during their stay and any costs incurred through loss, damage, loss of access to the property or keys not being returned will be charged to the client in full.

 

COT + HIGHCHAIRS

 

These are NOT available but we are happy for you to bring your own.

 

PETS

 

Curlew 1 The Cove and The Cove Site does not allow Dogs / Cats or any other Pet or Animal without full and prior Agreement. This facility is therefore in reality and practical terms for PROPERTY OWNERS only. It must also be noted that it is not permitted for any Daily / Visiting Guests that you may have; to bring any Pet on to the Site irrespective of whether they are left in a Car.

 

CARS

 

Curlew 1 has an allocated guaranteed reserved Car Parking Space. If your Group comes in 2 Cars there is an Overflow Visitors Car Park on site where a Space can be allocated. (Please confirm when Booking if you will require a second Car Space). There are NO Guaranteed Parking spaces for “day visitors” who should be advised to Park off-site.

 

BED LINEN & TOWELS

 

All bed linen, tea towels and personal towels are included in the holiday price, but no bedding is provided for cots. A hair dryer is provided. BATHING and RECREATIONAL towels are not provided and we ask that you bring your own. Towels that belong to Curlew 1 The Cove must not be removed for Bathing purposes under any circumstances.

 

ELECTRICITY and WATER CHARGES are included in the hire charge. (Please ensure that you acquaint yourselves and adhere to guidelines in respect of the underfloor Heating.

 

LIABILITY

Care must be taken by all guests at times. We do not accept responsibility for any damage to or loss of guests’ property, cars or contents and you agree to indemnity and hold us harmless from and against all actions, proceedings and claims (including reasonable legal fees incurred in defending the same) arising from your acts or omissions (and those in your party) whilst in our premises.

 

The Cove Site is located on top of Cliffs and Children Under 12 should be monitored at all times . Specific Rules for the Swimming Pool which is open from late May to mid September apply and must be read and adhered to. Unfortunately it is not possible for your Day Guests or Visitors to use the Swimming Pool out of consideration for Owners and also those also Booked in formally as Holiday Guests (e.g staying as a Booked Guest overnight)

 

 

SMOKING / VAPING –

For the benefit of all guests, the inside and Decking Area of Curlew 1 , The Cove is strictly NON SMOKING / NON VAPING as is The Swimming Pool Area .

 

OTHER OBLIGATIONS and SITE Regulations

 

You agree to thoroughly read and comply with the regulations set out in the Property manual available in Curlew 1 The Cove and any other regulations laid out by the Site Management Company. You agree to keep and leave the Property and the furnishings and electrical equipment, crockery and glasses clean and in good condition. Accidents can and do happen, if there are any breakages please leave a note for the Property Manager when you leave – genuine accidents will NOT be charged for.

 

You agree not to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties. Especially in relation to noise, wowdy behaviour in the surrounding communal areas and gardens and swimming pool area .

 

You must Park in your allocated Car Parking space at all times. The charging of Electric Vehicles is strictly forbidden.

 

You must not use the Property for any illegal or immoral purpose. The use of recreational drugs is strictly forbidden. If there is any evidence of their use you may be asked to leave immediately with no refund process and the local Devon and Cornwall Police will be notified.

 

You must take all necessary steps to leave the Property and your own Personal Possessions locked and secured at all times when you are not in the property and at night.

 

You agree to allow us or any representative of ours access to the Property at any reasonable time (8am to 10pm outside of emergencies) for the purpose of essential repairs or at any time in event of a health emergency.

 

The use of Drones either from the Property or from within the confines of The Cove site is NOT permitted without prior written approval from the Owners and Management Committee. You should adhere to rules concerning not riding Bicycles / Skateboards / Scooters or using Roller Skates on the Decking not within the Cove grounds. Ball Games should be respectful of neighbours.

 

Curlew 1 The Cove does NOT supply a BBQ and the use of disposable BBQ’s is strictly forbidden on The Cove site due to local Fire Regulations and the proximity of Woodlands.
